By using our services, you agree to comply with and be bound by the following terms and conditions. If you do not agree with these terms, please do not use our platform.
Eligibility
To use DealToDealer , you must be at least 18 years old and capable of entering into legally binding contracts. Dealers must be registered businesses with the appropriate licenses to buy and sell vehicles.
Account Registration
- Dealers: Dealers must register for an account, provide accurate and complete information, and maintain the confidentiality of their login credentials. Dealers are responsible for all activities that occur under their accounts.
- Private Sellers: Private sellers are required to provide accurate vehicle information and must have the legal right to sell the advertised vehicles.
Subscriptions and Fees
There will be no subscription fee for any customer on the platform, nor for the seller/private customer or for the Dealers.
Bidding and Purchasing
- Dealers can place bids on vehicles listed by private sellers. All bids are legally binding offers to purchase the vehicle if accepted.
- Once a bid is accepted, the dealer is required to complete the transaction within the timeframe specified by DealToDealer.
- Private sellers are not obligated to accept the highest bid but must act in good faith when selecting a winning bid.
Vehicle Listings
- Private sellers must provide accurate, truthful, and complete information about their vehicles. Misrepresentation or fraudulent behaviour will result in the removal of the listing and potential legal action.
- DealToDealer does not guarantee the condition, authenticity, or legality of the vehicles listed on the platform. It is the responsibility of the dealer to conduct due diligence before making a purchase.
Dispute Resolution
In the event of a dispute between a dealer and a private seller, DealToDealer will attempt to mediate but is not responsible for resolving the issue. Both parties agree to cooperate in good faith to resolve any disputes.
Termination
DealToDealer reserves the right to terminate or suspend access to the platform for any user who violates these terms and conditions or engages in fraudulent or illegal activities.
Limitation of Liability
DealToDealer is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our platform. This includes, but is not limited to, issues related to vehicle condition, misrepresentation, or payment disputes.
Changes to Terms
DealToDealer reserves the right to modify these terms and conditions at any time. Users will be notified of significant changes via email or through a notice on our platform.
Governing Law
These terms and conditions are governed by the laws of Victoria/Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Victoria/Australia.
